Terms of Use

These terms apply to the Herebeat iPhone app and the herebeat.app website (together, "Herebeat"). Herebeat is published by Nebula Edge LLC ("we", "us"). By using Herebeat you agree to these terms. If you don't agree, don't use it.

1. Not an emergency service

Herebeat collects information published by official and scientific sources. It can be delayed, incomplete, inaccurate or unavailable, including when you need it most. Never rely on Herebeat alone to decide whether you are safe. Always follow official warnings, local authorities and emergency services, and call your local emergency number in danger. Herebeat doesn't say that any place or route is safe.

2. The service

Herebeat shows alerts, conditions, forecasts, routes and places for the areas you choose. Coverage, sources and features differ by country and may change, be paused or be withdrawn. Third-party information belongs to its publishers and is shown as published, with the source named.

3. Subscriptions

Herebeat requires a paid, auto-renewing subscription bought through Apple's App Store. The app shows the price, length and any free trial before you buy.
Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends.
Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
Manage or cancel in your Apple Account settings. If you cancel, access continues until the end of the period you've paid for.
If you buy a subscription during a free trial, the unused part of the trial ends.

4. Your use of Herebeat

You get a personal, non-transferable licence to use Herebeat on Apple devices you own or control, as permitted by Apple's Usage Rules. Don't copy, resell, scrape or reverse engineer Herebeat or its data feeds. Don't disrupt the service or use it to break the law.

5. Apple

These terms are between you and us, not Apple. Apple isn't responsible for Herebeat or its content, maintenance, support or warranty, or for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Anything these terms don't cover is governed by Apple's Licensed Application End User License Agreement.

6. No warranty

To the fullest extent the law allows, Herebeat is provided "as is" and "as available", without warranties of any kind. That includes accuracy, timeliness, completeness, availability and fitness for a particular purpose.

7. Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential losses. That includes decisions made using Herebeat or losses caused by delayed, missing or wrong information. Our total liability for any claim is limited to what you paid for Herebeat in the 12 months before the claim. Nothing here limits liability that can't be limited by law, or your statutory rights as a consumer.

8. Changes and ending

We may update Herebeat and these terms. If a change is significant, we'll tell you in the app or on this page before it takes effect. You can stop using Herebeat at any time. We may suspend access if you break these terms.

9. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes go to the state or federal courts located in Delaware. If you're a consumer, you keep any right your local law gives you to bring a claim where you live, and the protection of your local mandatory consumer laws.
